With regard to the use, reproduction, and dissemination to the public for direct or indirect economic or commercial purposes of images of monuments, archaeological sites, and historical sites protected by Law 3028/2002 “On the Protection of Antiquities and Cultural Heritage in General” (A’ 153), we note that Article 46(7) of Law 3028/2002 and Joint Ministerial Decision No. ΥΠΠΟ/ΓΔΑΠΚ/ΔΜΕΕΠ/Γ2/Φ51-52-54/81397/2199/12-9-2005 – ( Β’ 1491) “Determination of fees for a) photography – cinematography – videography. “, as amended and in force, which specifies the licensing procedures, the amount of the fee and the method of collection, and any other necessary relevant details. This Joint Ministerial Decision provides for the licensing procedure for the use of images of archaeological content for commercial or advertising purposes in electronic titles on the Internet or Intranet, in electronic publications (e-books), and in the production of audiovisual works and electronic guides. The Greek State (Hellenic Ministry of Culture) is the exclusive owner of the rights to the content of these images. Consequently, the Greek State is the exclusive owner of the revenue from the depiction of monuments (movable or immovable) and their use in any form.

Furthermore, Law 4305/2014 (ΦΕΚ 237/Α/31-10-2014) provides for a special exemption for cultural heritage from further use for commercial or advertising purposes for the “protection of cultural heritage from theft, looting, vandalism, illegal excavation, antiquities trafficking, and in general to avoid exposing movable and immovable monuments and sites protected under Law 3028/2002 to danger.”
